A Commonwealth's Attorney should not prosecute a defendant who was a former client of the Commonwealth Attorney's former law firm on the same matter, although the Commonwealth's Attorney could rebut the inference of confidential knowledge by proving that the Commonwealth's Attorney did not work on the case while at the former firm.
