A part-time assistant public defender with a private practice may represent a client in a custody action even though the public defender's office previously represented the client's spouse in a sexual abuse case. The sexual abuse case was terminated before the lawyer became an assistant public defender and although the lawyer has heard general references to the accused spouse's personality, the lawyer has received no information from the file or any confidences or secrets.
