A government lawyer acting as "an administrative prosecutor before a regulatory agency or board": (1) is not governed by Rule 8.3, because that rule applies to criminal prosecutions and not to administrative proceedings; (2) is governed by Rule 3.1, and therefore "should not proceed unless there is a non-frivolous basis for doing so."
