A bank had a claim against a company based on a bank customer's allegations. The bank's lawyer asked whether the lawyer could advise the company's lawyer that the customer's allegations were true, even though they were mere allegations and had not yet been proven at trial. The Bar held that the bank's lawyer could not state with certainty that the customer's allegations were true, because they had not yet been proven at trial.
