40-Trust Accounts

Except as authorized by statute, a lawyer may not disburse funds from a trust account until the funds have cleared. A lawyer may not deposit a check endorsed by the client and the lawyer in the firm's trust account and write the client a check from the operating account for the amount the client is due (intending to reimburse the general account from the trust account once the check clears).
