16-Lawyer's Personal Interests

58-Real Estate Lawyers

A lawyer represents the lawyer's aunt in a dispute regarding real estate. The lawyer is interested in purchasing the real estate personally, and therefore must either terminate the representation of the aunt or make full disclosure and obtain her consent. [Under Rule 1.8(a), a lawyer may not enter into a "business transaction" with a client unless the client is given an opportunity to seek independent advice, and there has been full disclosure and consent in writing.]
