35-Threatening Criminal and Disciplinary Action

It is not per se unethical for a lawyer to threaten a criminal prosecution to gain an advantage in a criminal matter (the Bar concludes that the lawyer apparently had a tactical reason for pursuing perjury charges against a witness.)
