12-Withdrawing Lawyers (Including Non-Compete Issues)

55-Firm Names and Letterhead

A lawyer selling a law practice may advise clients that they may retain the new lawyer or some other lawyer. The lawyer purchasing the law practice may not purchase clients' files or an interest in pending litigation, and may not use the selling lawyer's name in the letterhead. [Rule 1.17 permits the purchase or sale of a law firm's practice, including good will, under certain circumstances.]
